1. Introduction
Welcome to Lumiquest ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the Lumiquest website and goal-tracking application for children ("Service").
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.
2. Account Registration
To use certain features of our Service, you must register for an account. When you register, you agree to provide accurate, current, and complete information about yourself and to update this information to keep it accurate, current, and complete.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. We encourage you to use a strong password (a combination of upper and lower case letters, numbers, and symbols) for your account.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
3. Child Accounts
Our Service allows you to create and manage accounts for children. By creating a child account, you represent that:
- You are the parent or legal guardian of the child, or have the authorization from the parent or legal guardian to create the account
- You consent to the collection and use of limited information about the child as described in our Privacy Policy
- You will supervise and be responsible for the child's use of the Service
You are solely responsible for monitoring the child's use of the Service and ensuring that the content and activities are appropriate for the child.
4. Subscription and Payment
We offer both free and premium subscription plans. By selecting a premium plan, you agree to pay the subscription fees indicated for that service. Payments will be charged on the day you sign up for a premium plan and will cover the use of that service for the period indicated.
Subscription fees are non-refundable except as required by law or as explicitly stated in these Terms. We reserve the right to change subscription fees at any time, but will give you reasonable advance notice of these changes through our Service or via email.
You can cancel your subscription at any time through your account settings or by contacting us. If you cancel, you can continue to use the premium features until the end of your current billing period, but you will not receive a refund for the current billing period.
5. User Content
Our Service allows you to create, upload, and share content such as goals, rewards, and progress information ("User Content"). You retain all rights to your User Content, but you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such User Content for the purpose of providing and improving our Service.
You represent and warrant that:
- You own or have the necessary rights to the User Content you post
- The User Content does not violate the rights of any third party, including intellectual property rights and privacy rights
- The User Content does not contain material that is unlawful, defamatory, or otherwise objectionable
We reserve the right to remove any User Content that violates these Terms or that we find objectionable for any reason, without prior notice.
6. Prohibited Uses
You agree not to use the Service:
- In any way that violates any applicable law or regulation
- To impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity
- To send unsolicited promotional or advertising material
- To attempt to gain unauthorized access to any portion of the Service or any other systems or networks connected to the Service
- To collect or harvest any personally identifiable information from the Service
- To interfere with or disrupt the Service or servers or networks connected to the Service
- To transmit any material that contains viruses, Trojan horses, worms, or any other harmful or destructive code
Prohibited Rewards and Misuse
Our Service is designed to promote positive child development through appropriate goal-setting and rewards. It is strictly forbidden to use the Service in ways that are morally inappropriate, harmful, or exploitative, including but not limited to:
- Sexual content or rewards of any nature
- Discriminatory practices that reinforce bias based on race, gender, religion, sexual orientation, or any protected characteristic
- Psychological manipulation or emotional abuse, such as using the app to shame, humiliate, or excessively control a child
- Religious or ideological indoctrination that imposes extreme beliefs or practices
- Exploitation of child labor by setting goals that require excessive work or chores inappropriate for the child's age
- Rewards that encourage dangerous behavior or risk-taking activities that could result in physical harm
- Rewards involving substances inappropriate for children (alcohol, tobacco, drugs, etc.)
- Rewards that involve deception or teaching children to lie or engage in dishonest behavior
- Rewards that promote materialism or excessive consumerism as primary values
- Using the app to replace appropriate parental guidance or as a substitute for addressing behavioral issues that require professional help
- Setting unrealistic or harmful goals that could negatively impact a child's self-esteem or well-being
- Any use that contradicts the best interests of the child or could be considered abusive or neglectful
Lumiquest is committed to child welfare and ethical use of our platform. We reserve the right to review content, goals, and rewards to ensure compliance with these Terms. Violation of these prohibitions will result in immediate termination of your account without refund and may be reported to appropriate authorities when legally required.
Prohibited Goal Settings
The goals you set for children using our Service must be age-appropriate, ethical, and conducive to positive development. The following types of goals are strictly prohibited:
- Physically harmful goals that could lead to injury, exhaustion, or health problems (e.g., extreme physical challenges, dangerous stunts, unhealthy weight loss)
- Academically unreasonable goals that create excessive pressure or set unrealistic expectations (e.g., demanding perfect scores on all tests)
- Goals that violate privacy or personal boundaries of the child or others
- Goals involving deception or encouraging dishonesty (e.g., lying to others, cheating)
- Goals that promote prejudice or discrimination against any individual or group
- Goals that involve inappropriate adult responsibilities beyond the child's developmental stage
- Goals that encourage unhealthy relationships with food, body image, or appearance
- Goals that involve exposure to age-inappropriate content (violence, sexual content, etc.)
- Goals that undermine authority figures such as teachers or other caregivers
- Goals that involve illegal activities or breaking rules at school or other institutions
- Goals that exploit the child for the benefit of adults (e.g., using the child to gain social media attention)
- Goals that discourage critical thinking or promote blind obedience
- Goals that create unhealthy competition or encourage putting others down
- Goals that involve keeping secrets that should appropriately be shared with trusted adults
All goals should be designed to promote positive development, build healthy habits, and support the child's wellbeing. Goals should be challenging yet achievable, and should respect the child's autonomy, dignity, and individual pace of development.
7. Intellectual Property
The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Lumiquest and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.
Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Lumiquest.
8. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or delete your account through the account settings.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
9. Limitation of Liability
In no event shall Lumiquest, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the Service
- Any conduct or content of any third party on the Service
- Any content obtained from the Service
- Unauthorized access, use, or alteration of your transmissions or content
Whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
10. Disclaimer
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
Lumiquest does not warrant that the Service will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that the Service or the servers that make it available are free of viruses or other harmful components.
11. Governing Law
These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Lumiquest operates, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
12. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
